Prevailing Party

Prevailing Party means:
any party (other than the United States or a creditor of a taxpayer) that substantially prevails with respect to the amount in controversy or the most significant issue(s) in a civil tax case. Former IRC (check if this IRC provision is current here) §7430(c)(4).
